Overview
This site is operated by Refuge Linen LLC of Telluride, Colorado. By using the site or placing an order, you agree to these terms. Our store runs on Shopify’s e-commerce platform, which hosts the site and processes checkout on our behalf.
Online store terms
You must be at least 18 years old, or have a parent or guardian’s permission, to use this site or place an order. You agree not to use this store for any unlawful purpose or in any way that could damage, disable, or impair it. A violation of these terms may result in your access being terminated.
General conditions
We can refuse service to anyone, for any reason, at any time. Information you submit, aside from payment details, which are always encrypted, may travel over networks in a way that isn’t encrypted end-to-end. You agree not to copy, resell, or otherwise exploit any part of this site or its content without our written permission.
Accuracy of information
We try to keep information on this site current and accurate, but we don’t guarantee it, and this site may occasionally contain outdated information. We can correct errors, update information, or change content at any time without notice, and we’re not obligated to update anything unless the law requires it.
Prices and modifications
All prices are listed in US dollars. Prices, products, and availability can change without notice, and we may modify or discontinue any product, or the site itself, at any time, without liability to you for doing so.
Products
Products are subject to availability and may be limited to a certain quantity per customer or order. We’ve done our best to display colors accurately, but we can’t guarantee your screen will show the exact color of the linen. Linen is a natural fiber, and some color variation between batches is normal.
Billing and account information
We reserve the right to refuse or cancel any order, and to limit or cancel quantities purchased per customer, per household, or per order, including orders that appear to use the same account, card, or address as another restricted order. You agree to provide accurate, current information when you place an order, and to keep your account information up to date.
Optional tools
We may give you access to third-party tools we don’t control or monitor. Any such tools are provided “as is,” without warranty, and your use of them is at your own risk and subject to that third party’s own terms.
Third-party links
This site may link to third-party websites or include third-party content. We aren’t responsible for, and don’t endorse, the content, products, or practices of any third party, and any transaction you make with one is between you and them.
User comments & submissions
If you send us feedback, reviews, or other submissions, you agree we can use, edit, and publish them without compensation or obligation to respond. You’re responsible for making sure anything you submit is truthful, doesn’t infringe on anyone else’s rights, and isn’t unlawful, abusive, or misleading.
Errors, inaccuracies, and omissions
Occasionally this site may contain typos or errors relating to product descriptions, pricing, or availability. We reserve the right to correct these and to change or cancel orders affected by them, even after you’ve placed an order, without prior notice.
Prohibited uses
In addition to anything else stated in these terms, you may not use this site: for any unlawful purpose; to violate any law or regulation; to infringe our intellectual property or anyone else’s; to harass, discriminate against, or harm others; to submit false or misleading information; to transmit viruses or malicious code; to collect other users’ personal information; to spam, phish, or scrape the site; or to interfere with or bypass the site’s security.
Warranty and limitation of liability
Every piece we sell is covered by a 12-month warranty against manufacturing defects, flaws in materials or construction, not normal wear, washing, or misuse. If something you’ve bought fails because of how it was made, contact us at rest@refugelinen.com and we’ll make it right. For something as minor as a loose or missing button, we’ll simply send a replacement rather than requiring the piece be returned.
Outside of that warranty, this site and its products are provided “as is,” without other warranties of any kind, express or implied, to the fullest extent the law allows. Refuge Linen LLC’s liability for any claim related to a purchase is limited to the amount you paid for that product. Nothing in these terms limits any rights you hold under law that cannot be waived by agreement, including any statutory consumer protections in your state.
Indemnification
You agree to indemnify and hold Refuge Linen LLC harmless from any claim or demand, including reasonable attorneys’ fees, arising from your breach of these terms or your violation of any law or the rights of a third party.
Severability and termination
If any provision of these terms is found unlawful or unenforceable, the remaining provisions still apply. Either party may terminate this agreement at any time; if we believe you’ve violated these terms, we may terminate your access to the site without notice, and you’ll remain responsible for anything you owe as of that date.
Entire agreement
These terms, along with any policies referenced here, are the entire agreement between you and us regarding your use of this site, and replace any earlier agreements or understandings on the same subject. If we don’t enforce a particular provision on one occasion, that doesn’t waive our right to enforce it later.
Governing law
These terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions.
Changes to these terms
We may update these terms at any time. The version posted on this page at the time of your order is the one that applies.
